3、Qualification Requirements For Bidder
Qualifications or Performance:Legal persons or other organizations from the People's Republic of China or from countries or regions having normal trade relations with the People's Republic of China that meet the following conditions shall, in addition to satisfying the requirements for Qualified Bidders set forth in Subclause 2.2 of Volume 1, Chapter 1 Instructions to Bidders of the 2014 edition of International Competitive Bidding Documents for Mechanical and Electrical Products Procurement compiled by the Department of Mechanical, Electronic and High-Tech Industry, Ministry of Commerce of the People's Republic of China, also meet the following conditions:
1)Manufacturers may independently participate in bidding. Domestic manufacturers within the customs territory shall hold a valid business license and a production license for the bid products; overseas manufacturers outside the customs territory shall be legally registered in their home country or region.
2)The national general agent of the bid products, or the agent listed in the medical device registration certificate or registration form (hereinafter referred to as the "Agent"), may also participate in bidding. The national general agent shall hold a valid national general agent certificate within its validity period.
3)Distributors (or agents) authorized by the manufacturer, national general agent, or Agent may also participate in bidding.
4)Domestic distributors (or agents) within the customs territory and their authorizing national general agent or Agent shall hold a valid business license and a medical device operation filing certificate or a valid operation license; overseas distributors (or agents) outside the customs territory shall be legally registered locally and hold a manufacturer's authorization.
5)The bid products must obtain a medical device registration certificate (applicable to Class II and Class III medical devices).
6)The bidder has not been listed in the List of Dishonest Persons Subject to Enforcement, the List of Parties to Major Tax Illegal Cases on the Credit China website (www.creditchina.gov.cn), nor in the List of Records of Serious Illegal and Dishonest Behaviors in Government Procurement on the Chinese Government Procurement website (www.ccgp.gov.cn).
